(“Engin8,” “we,” “us,” or “our”) values your privacy and is committed to protecting personal information collected through Engin8.io (the “Website”) and our related products, services, platforms, and tools (collectively, the “Services”). Engin8 operates as a business-to-business (B2B) platform providing SaaS solutions and related professional services, staOng, marketing, advertising, aOliate, analytics, and internal operational tools.

Scope of This Privacy Policy

This Privacy Policy applies to:

  • Visitors to the Website
  • Businesses and authorized users who create accounts or use our Services
  • Clients, partners, and aOliates using the Services

This Policy does not apply to third-party websites, platforms, or services that may be linked to or integrated with Engin8 or any Services. For example, when we facilitate placements through our third-party staOng solution provider relationship, such staOng provider maintains direct contractual relationships with the applicable personnel that is placed and is responsible for their personal information as a separate data controller. All of these third- party websites, platforms, and services may have their own privacy policies. Some of these services (including our staOng solution services) have additional requirements as described in their service-speciUc additional terms and policies.

Customer Data vs. Service Data

For purposes of this Privacy Policy, we distinguish between two categories of information:

“Customer Data”

means any data, content, or information that you or your authorized users provide to Engin8 or that Engin8 accesses on your behalf from third-party platforms (such as Amazon Seller Central), including but not limited to: sales data, inventory information, performance metrics, vendor documents, and business records. With respect to Customer Data, you are the data controller and Engin8 acts as a data processor or service provider. You retain all ownership rights to Customer Data. Customer Data is processed solely on your behalf and according to your instructions.

“Service Data”

means personal information that Engin8 collects or generates during the provision and administration of the Services, excluding Customer Data. Service Data includes: account registration information (name, email, phone number, company name), login credentials, payment and billing information, usage logs and analytics, IP addresses, device information, cookie data, support communications, and other information collected through your use of the Website and Services. With respect to Service Data, Engin8 is the data controller.

Information We Collect
Legal Bases for Processing

For users in jurisdictions requiring a legal basis for processing, we process personal information based on: (a) contractual necessity to provide Services; (b) legitimate business interests in operating and improving our Services; (c) compliance with legal obligations; and (d) consent where required by law.

  • Amazon Seller Central account and/or Vendor Central account credentials and access tokens
  • Business data, documents, and records accessed through your Amazon Seller Central and/or Vendor Central account
  • Sales data, inventory information, and performance metrics from Amazon
  • Any other data you upload to or make available through the Services

Customer Data is processed solely to provide Services to you and according to your instructions. Engin8 does not use Customer Data for any other purpose unless required by law or with your explicit consent. You represent and warrant that you have all necessary rights and authorizations to provide Customer Data to Engin8 and to permit Engin8 to process such data as described in this Privacy Policy and our Terms of Service.

We collect Service Data that you voluntarily provide or make available to us, for example, when you interact with our billing or support teams, including:

  • Full name
  • Business email address
  • Phone number
  • Company name
  • Login credentials and account information
  • Messages, inquiries, or support communications
Payment Information

Payments are processed through a third party payment processor as identiUed by Engin8 from time to time. Engin8 does not store full payment card details. We may receive limited, tokenized payment information and transaction metadata for billing and record-keeping purposes. Such third party payment processors have their own privacy practices.

When you access or use the Services, we automatically collect Service Data which includes among other things, certain technical and usage data, including:

Engin8 operates aOliate and partner programs and may track referrals, conversions, and performance metrics using cookies, pixels, and analytics tools such as Google Analytics. These technologies help us understand usage patterns and improve our Services.

Engin8 does not sell personal data as deUned under applicable privacy laws. However, the use of advertising pixels, retargeting cookies, and analytics tools may constitute “sharing” for targeted advertising purposes under certain state privacy laws, and users may have the right to opt out of such sharing.

Data Deletion or Retention

All personal data collected directly by Engin8 is stored and processed within the United States. However, data accessed from your third-party accounts may be stored on servers of such third-party service provider, which may be located in various jurisdictions depending on such third-party service provider’s infrastructure. Engin8 does not control the location of data stored by any such third-party service provider.

Service Data is used to:
  • While your account remains active and you are using the Services
  • After termination, for a limited transition period (typically 30 days unless otherwise specified) to allow data retrieval
  • Customer Data will be deleted or returned according to your written instructions upon termination
  • Except as required by law or to defend legal claims

We retain Service Data for different periods of time depending on the type of data, how we use it, and how you configure your settings. Our notice to you will also include, among other things, measures taken by Engin8, or plans to take, to address the Incident and mitigate potential risk, measures, if any, that we may recommend our customers take to address any such Incident, and details of a contact point where more information can be obtained. If it isn’t possible for Engin8 to provide all such information in the relevant notice at the given time, Engin8’s initial notice will contain the information that is currently available to it; further information will be provided without undue delay as it becomes available.

Engin8 has no obligation to assess your data in order to identify information subject to any speciUc legal requirements and our notiUcation of, or response to, any Incident under this section will not be construed as an acknowledgement of fault or liability with respect to such Incident on Engin8’s part. Our customers and users are responsible for their use of our Services and storage of any copies of their data outside of our (or our subprocessors’) systems. This means that our customers and users are responsible for, among other things: (1) using the Services to ensure a level of security appropriate to the risk related to their data; (2) backing up or retaining copies of such data as appropriate; and (3) securing account authentication and related access credentials, systems, and devices that are used by our customers or users to access or use any of our Services. Any notices contemplated under this section will be delivered to the notiUcation email address that we have on Ule with respect to the applicable customer or user, and our customers and users are responsible for ensuring that such notiUcation email address remains current and valid.

If you become aware that any of your personal data is inaccurate or outdated, you are responsible for rectifying or deleting data if required by applicable law or provide notice thereof to us so that we may do the same. We will respond to verified requests within the timeframes required by applicable law. You may designate an authorized agent to make requests on your behalf by providing written authorization.
